By accessing the Website or purchasing our services, you acknowledge that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the site and must discontinue use immediately.

  1. Description of Services

Cloud Vista provides premier cloud hosting infrastructure, data storage, and scalable web hosting solutions ("Services"). We guarantee a 100% Uptime Commitment for your applications under our standard SLA, subject to scheduled system maintenance and force majeure events.

  1. User Accounts & Registration
  • Account Security: You must register an account to access our cloud services. You agree to keep your password confidential and notify us immediately at [email protected] if you suspect unauthorized access.
  • Accuracy of Data: You are required to provide current, accurate, and complete contact and billing information. [2, 3]
  • Responsibility: You assume full legal responsibility for all activities, data transfers, and deployment operations that occur under your user credentials.
  1. Fees, Billing, and Renewals
  • Subscription Model: Services are billed on a recurring subscription basis (monthly or annually) according to your chosen plan.
  • Automatic Renewal: To ensure continuous deployment, your subscription will automatically renew at the end of each billing cycle unless cancelled manually before the renewal date.
  • Taxes and Fees: You are responsible for all applicable taxes associated with your use of the platform, including the Goods and Services Tax (GST) in India.
  • Refund Policy: All sales are final. Refunds for partial subscription periods or unused cloud resource allocations are handled solely at our discretion.
  1. Acceptable Use Policy

You agree not to use the Cloud Vista network or infrastructure to host, upload, or transmit any content that violates the Information Technology Act, 2000, or the IT Rules, 2021. This includes, but is not limited to, content that:

  • Belongs to another person and to which you do not have any right.
  • Is defamatory, obscene, pornographic, pedophilic, or invasive of another's privacy.
  • Infringes any patent, trademark, copyright, or other proprietary rights.
  • Contains software viruses, malware, or any other computer code designed to interrupt or limit system functionality.
  • Threatens the unity, integrity, defense, security, or sovereignty of India. [4, 5]
  1. Data Ownership and Security
  • Client Content: You retain 100% legal ownership and intellectual property rights over all data, code, files, and applications you upload or host on our platform.
  • Data Retrieval: Upon termination of services, you will have a 30-day window to safely download and migrate your content from our servers. After this period, we reserve the right to permanently delete your data.
  • Platform Protection: We implement industry-standard encryption, firewalls, and active threat monitoring to protect the overarching network architecture.
  1. Intellectual Property Rights

Unless otherwise indicated, the Website design, structural source code, databases, software functionality, text, and logos on mycloudvista.com are our proprietary property and are protected by copyright and trademark laws. You are granted a limited, non-exclusive license to access the dashboard solely for managing your active services. [6]

  1. Limitation of Liability

To the maximum extent permitted by law, Cloud Vista, its directors, or employees shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, data corruption, or business interruption resulting from service downtime. Our total liability for any claim arising out of these terms shall not exceed the amount paid by you for the specific service during the six (6) months prior to the claim.

  1. Suspension and Termination

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, if you violate any provision of these Terms or engage in fraudulent activities that threaten network stability. You may cancel your subscription at any time via your account control panel.

  1. Governing Law and Jurisdiction

These Terms and any disputes arising out of your use of the platform shall be governed by and construed in accordance with the laws of India. Any legal actions, suits, or proceedings arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Kanpur, Uttar Pradesh, India.
